Terms of Service

These terms cover atmosperformance.com, the Members area, and the Note Taker (together, the “Service”), run by Atmos Performance, Inc. (“ATMOS”, “we”). By using the Service you agree to them. Equipment purchases and memberships have their own order terms that you see at checkout.

Your account

  • You need an account for the Members area. Keep your sign-in details to yourself and tell us if you think someone else is using them.
  • You are responsible for what happens under your account.
  • Accounts are for businesses and adults. One person, one account.

The Note Taker and session records

The Note Taker is a record-keeping tool. It stores what you type and helps you organize it. It does not diagnose, treat, or give medical or veterinary advice, and nothing on the Service should be read that way.

  • You are responsible for the accuracy of your notes and for deciding how to treat your clients.
  • You must have your clients’ permission to record notes about them and to email those notes where you direct.
  • You keep ownership of your notes. You give us permission to store, display, and email them as needed to provide the Service.
  • Follow the laws that apply to your practice, including any health-record or privacy rules in your state or country.

Using ATMOS equipment

ATMOS devices must be used as described in the training and the product documentation. Training materials in the Members area are for operators who have purchased or are evaluating an ATMOS device. Do not share them outside your business.

What you may not do

  • Break into, overload, or interfere with the Service or other people’s accounts.
  • Use the Service to send spam or to record information about people without permission.
  • Copy, resell, or scrape the Service or its content.

Memberships and payments

Some parts of the Members area require a paid membership. Prices, billing periods, and renewal terms are shown before you pay. Payments are handled by Stripe. You can cancel a renewing membership from your account before the next billing date.

Our content

The site, its text, videos, images, and software belong to ATMOS or our licensors. You may use them to evaluate and operate ATMOS products. Case studies you publish from your own notes are yours.

No warranty

The Service is provided “as is”. We work to keep it available and accurate, but we cannot promise it will always be error-free or uninterrupted. Keep your own copies of anything important.

Limits on liability

To the extent the law allows, ATMOS is not liable for indirect, incidental, or consequential damages arising from the Service, and our total liability for any claim relating to the Service is limited to the amount you paid us for it in the 12 months before the claim. This does not limit liability that cannot be limited by law.

Ending an account

You can close your account at any time by emailing us. We may suspend or close an account that breaks these terms. When an account closes, we delete its data as described in the Privacy Policy.

Governing law and changes

These terms are governed by the laws of the State of California. Disputes will be handled in the state or federal courts located in California.

We may update these terms. If a change matters, we will update the date at the top and email account holders. Continuing to use the Service after a change means you accept it.
